Terms & Conditions
The holder of a valid ticket (“holder”) is admitted to the event on the condition that the holder agrees to: (i) the Conditions of Sale (“conditions”) in favour of the McMichael Canadian Art Collection (“the Institution”) as set out below, and (ii) to all rules and conditions imposed by the venue. If under the age of 18, the holder of this ticket represents and warrants that s/he has obtained the prior authorization, permission and consent from his/her parents or legal guardians to attend the event. These Conditions of Sale also apply to any and all transportation provided by the Institution to and/or from the event.
Conditions of Sale
This ticket is a personal, revocable license. All tickets are non-refundable, non-transferable, and non-replaceable in the case of loss or destruction. Tickets are only valid on the event date. Unused tickets have no cash value. The event is subject to change without notice. The McMichael Canadian Art Collection may postpone, cancel, interrupt or stop the event due to adverse weather, dangerous situations, or any other reason beyond the control of the Institution. If the event cannot be held or is cancelled before the event commences for any reason beyond the control of the Institution or its subcontractors/co-promoters, all reasonable efforts will be taken to reschedule the event. Under no circumstances will a refund be granted to a holder who is unable to attend the event.
The holder grants to the Institution a fully paid, perpetual right to all photographs, video or audio recordings of the holder taken or made at the event by the Institution, its agents, entertainers, employees, subcontractors and/or co-promoters, and assigns, and hereby consents to the use, reproduction, broadcast and distribution of said photographs, video or audio recordings for promotional and marketing purposes for the Institution.
The holder acknowledges and voluntarily assumes all risks and danger related in any way to the event including, without limitation, risks of personal injury, property loss and/or damage, arising or resulting from any cause whatsoever and whether occurring prior to, during, or after the event. The holder agrees that the McMichael Canadian Art Collection, its agents, entertainers, employees, subcontractors and/or co-promoters, and assigns are expressly released and forever discharged by the holder from any and all claims arising from or relating to such risks or otherwise occurring at or in connection with the event.
The holder hereby agrees to indemnify, defend and hold the Institution and all officers, directors, owners, agents, entertainers, employees, subcontractors and/or co-promoters, and assigns (collectively “the indemnified parties”) from and against any and all liability and costs incurred by the indemnified parties in connection with any claim arising out of any breach of these conditions by the holder.
The Institution reserves the right without refund or compensation to seize or cancel the ticket, withdraw the license granted above, refuse admission and/or expel a holder who damages the venue in any manner whatsoever and/or whose conduct is disorderly, verbally or physically abusive, disrespectful, harassing, poses a threat to security, or to the enjoyment of the event by others, or due to any violation of the conditions. If any of the provisions (or parts thereof) contained in these Terms and Conditions are determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions (or parts thereof) contained herein.
